{"id":70782,"date":"2024-12-14T08:00:08","date_gmt":"2024-12-14T13:00:08","guid":{"rendered":"https:\/\/wawa-news.com\/?p=70782"},"modified":"2024-12-14T07:40:55","modified_gmt":"2024-12-14T12:40:55","slug":"approval-of-a-national-class-action-settlement-with-dollarama-concerning-ecofees","status":"publish","type":"post","link":"https:\/\/wawa-news.com\/index.php\/2024\/12\/14\/approval-of-a-national-class-action-settlement-with-dollarama-concerning-ecofees\/","title":{"rendered":"Approval of a National Class Action Settlement with Dollarama concerning Ecofees"},"content":{"rendered":"<p><b><\/b>By judgment rendered on <span class=\"xn-chron\">December 3, 2024<\/span>, the Superior Court of <span class=\"xn-location\">Quebec<\/span> approved the Dollarama national class action settlement (Superior Court of <span class=\"xn-location\">Quebec<\/span>, no. 500-06-001243-233). Canadians that are part of the following class may now be entitled to compensation under certain conditions:<\/p>\n<p>&#8220;All persons who purchased a product subject to an Environmental Handling Fee (&#8220;EHF&#8221;) from Dollarama in <span class=\"xn-location\">Quebec<\/span> between <span class=\"xn-chron\">December 11, 2019<\/span> and <span class=\"xn-chron\">July 4, 2023<\/span>, or elsewhere in <span class=\"xn-location\">Canada<\/span> between <span class=\"xn-chron\">April 29, 2021<\/span> and <span class=\"xn-chron\">July 4, 2023<\/span>.&#8221;<\/p>\n<p>Recall that the proposed class action was initially filed against Dollarama (and other Defendants) on <span class=\"xn-chron\">May 29, 2023<\/span>, regarding the prices advertised and charged for products subject to Environmental Handling Fees (&#8220;<b>EHFs<\/b>&#8220;) sold in <span class=\"xn-location\">Canada<\/span> (for example: batteries, electronic products, lightbulbs or toys with batteries). The Plaintiff essentially alleged, among other things, that Dollarama did not properly advertise (display) the price of products subject to EHFs it offered for sale and that it charged a total price or EHFs higher than displayed for these products or allowed by law.<\/p>\n<p>Dollarama has agreed to pay a total amount of <b><span class=\"xn-money\">$2,643,718.75<\/span> <\/b>(the &#8220;<b>Settlement Amount<\/b>&#8220;) to be used to notably compensate Approved Claimants in the form of Interac E-Transfers, to a maximum of <span class=\"xn-money\">$10.00<\/span> each, depending on the total number of Approved Claimants. Each Approved Claimant can only get one Interac E-Transfer regardless of the number of products subject to Ecofees they purchased from Dollarama during the Class Period. If the total number of Approved Claimants results in Interac E-Transfers worth less than <span class=\"xn-money\">$3.00<\/span> each, no Interac E-Transfers will be made and the Distribution Fund will be paid to charities approved by the Court.
